Terms of Use

1. Agreement

These Terms of Use ("Terms") are an agreement between you and Bloomberg Group LLC, a Wyoming limited liability company ("MBG Hotels", "we", "us" or "our"). They govern your use of the MBG Hotels digital concierge platform, websites and apps (the "Service"). By creating an account or using the Service you agree to these Terms. If you accept them on behalf of a hotel or other business, you confirm that you are authorised to bind that business.

2. The Service

MBG Hotels lets hotels and other hospitality businesses publish their menus, services and information to guests through QR codes, and receive and manage guest orders and requests. Guests pay the hotel for their orders in the way the hotel chooses; we do not process payments between hotels and their guests.

3. Accounts

To use the Service you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Keep your login details secure
  • Take responsibility for all activity under your account
  • Tell us promptly about any unauthorised use

4. Your Responsibilities as a Hotel

You are responsible for the content you publish (including menus, prices, descriptions and images), for fulfilling the orders and requests your guests place, and for complying with the laws that apply to your business, including food, alcohol, consumer-protection and data-protection laws relating to your guests. Automatic translations are provided for convenience; please review them before relying on them.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe the rights of others
  • Upload harmful, unlawful or malicious content
  • Attempt to gain unauthorised access to our systems
  • Interfere with the proper functioning of the Service

6. Subscriptions, Trials and Billing

Paid plans are billed in US dollars, monthly or yearly as you choose. Payments are processed by Dodo Payments, which acts as the merchant of record for your purchase and handles payment collection, invoicing and applicable sales tax or VAT.

  • New subscriptions may include a 14-day free trial. A valid payment method is required to start it.
  • Unless you cancel before the trial ends, your subscription starts automatically and then renews at the end of each billing period at the price in effect at that time.
  • You can cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period, and you keep access until then.
  • Fees are non-refundable except where required by law.
  • We will give you at least 30 days’ notice of any price change before it applies to your next renewal.
  • Subscriptions bought through the Apple App Store are billed and managed by Apple under its own terms.

7. Intellectual Property

The Service and its software, design and content are owned by Bloomberg Group LLC and protected by copyright, trademark and other intellectual-property laws. You keep ownership of the content you submit and grant us a limited licence to host, translate, display and process it only to provide the Service to you.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free or completely secure.

9. Limitation of Liability

To the maximum extent permitted by law, Bloomberg Group LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunities, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amounts you paid us in the 12 months before the claim arose.

10. Termination

You may close your account at any time. We may suspend or terminate your access if you breach these Terms or if required by law. When your account ends, your right to use the Service ends with it.

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and, for significant changes, notify you by email or in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
